Letter to Senator Mike Crapo, (R-ID)
In your response, you state, that "only native-born U.S. citizens (or those born abroad, but only to parents who were both American citizens) may be President of the United States.
Article II, Section 1, Clause 5, of the U.S. Constitution requires the president to be a natural-born U.S. citizen, not a native-born U.S. citizen.
You also state, "some individual have filed lawsuits in state and federal courts alleging that he has not proven that he is an American citizen but each of those lawsuits have been dismissed."
Those lawsuits, Senator Crapo, were dismissed on procedural grounds, not on merit. As such, the dismissal of the cases does not prove that Barack Obama is an American citizen.
You also state, "Furthermore, both the Director of Hawaii's Department of Health and the state's Registrar of Vital Statistics recently confirmed that Mr. Obama was born in Honolulu, Hawaii on August 4, 1961 and, as such, meets the constitutional citizenship requirements for the presidency."
Follows is the exact wording of the press release of Dr Fukino, director of Hawaii's Department of Health, October 31, 2008
“There have been numerous requests for Sen. Barack Hussein Obama’s official birth certificate. State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.
“Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures.
“No state official, including Governor Linda Lingle, has ever instructed that this vital record be handled in a manner different from any other vital record in the possession of the State of Hawai‘i.”
There is nothing in that press release that states Obama was born in Honolulu. The Hawaii Act 96, in effect from 1911 until 1972, allowed for the birth registration of foreign born children in Hawaii. Until the long-form birth certificate is produced and examined, where Obama was actually born is unknown.
The Department of Health, State of Hawaii, has gone on record stating they cannot confirm the authenticity of the document that Barack Obama claims is his birth certificate but that is actually a certification of live birth. That COLB has appeared at various places on the web and has been determined to be altered/forged. To obtain the COLB from the state of Hawaii requires a written request. A request for disclosure of all documents under all the names by which Barack Obama is known, has produced no such written request for a COLB.
It is the duty of Congress not the Supreme Court to address this problem. Senators and Representatives were aware of the eligibility issue and had the evidence before them before they certified the electoral college on January 8, 2009. It is the sworn duty of every elected official in Washington, DC, to uphold the Constitution.
